A 50 year old male from Sioux City, Iowa, was sentenced to 60 days in prison on Tuesday after initially submitting a guilty plea in federal court in November to trafficking misbranded drugs with intent to defraud or mislead. In November 2011, David Kempema had admitted that from about 13 October 2009, through to 9 July 2011, he advertised and offered for sale drugs bearing the names of the prescription only erectile dysfunction medications - Viagra and Cialis. To market the drugs to potential customers, Kempema operated under the business names La Costa Direct, Generics Direct, and Canned Ads. Kempema imported generic drugs from India, these being ‘Viprogra-100’ and ‘V-Tada 20’. When a customer placed an order for Viagra, he would simply supply them with Viprogra-100, and then used V-Tada 20 for Cialis orders. Neither of the aforementioned drugs are approved by the United States Food and Drug Administration (FDA), nor do they have any accompanying documentation for directions of use, possible side effects, etc. As part of his plea agreement, Kempema admitted to selling approximately 2505 Viprogra-100 pills and approximately 1263 V-Tada 20 pills. From those sales he pocketed $23,723.25, and has been forced to relinquish this amount back to the U.S. government. In a further calculating act of deception, Kempema attempted to pull the wool over the eyes of authorities and customers by shipping the erectile dysfunction drugs with a fictitious return address from Costa Rica.
